ISPs in the US under FCC’s Scanner

The US Federal Communications Commission (FCC) has added yet another note to its net neutrality drive, with Chairman Julius Genachowski calling for the formulation and implementation of laws regulating the way the internet service providers (ISPs) generate and provide online content to their customers. The new laws, if legislated, would be based on a set of recommendations already made by the FCC to promote transparency in ISP content and increasing accountability to customers.

The FCC appeal comes in the wake of fears that the ISPs might misuse the power they have over the distribution and dissemination of information delivered to internet users. Its fears are not baseless, as there have been reports of subjective restrictions of both politically inclined content and of certain software by the ISPs to further their corporate interests. The FCC believes the service providers may start choosing the content they present to the public, thus undermining the open and accessible nature of the internet and its identity as a powerful new age media.

Complaints to Ofcom Fewer This Year

No Agreement in Sight for Spectrum Reallocation

The 900MHz broadband spectrum, which was awarded to Vodafone and O2 in the 1980s, has become a major bone of contention among mobile broadband UK suppliers because it has been identified as the ideal range for providing mobile broadband in the country.

The problem is that Vodafone and O2 are not willing to share the spectrum with other telecom suppliers. To arrive at a mutually acceptable decision regarding reallocation of the spectrum, several talks have already been held. The April 30 deadline set by the government for reaching an agreement has already passed and it now seems that alternative solutions for the deadlock would be sought.

Kip Meek, the right hand man of Communications Minister Stephen Carter, recently revealed that getting Britain’s mobile broadband suppliers to reach a consensus on the spectrum reallocation issue was turning out to be almost impossible. Meek presented a fresh solution to resolve the issue, suggesting that Vodafone and O2 be allowed to retain their possession of the 900MHz chunk but be refrained from owning any part of the spectrum that would be available in 2012, when TV signals switch from analogue to digital TV formats. He feels this solution would be fair to all operators and would thus eventually help enable the availability of broadband connectivity in rural areas.

However, other suppliers such as T-Mobile and O2 are not too happy with Meek’s solution and are supporting the alternative presented by Ofcom, which suggests that some of the 900MHz spectrum be taken away from Vodafone and O2 and be divided among all the service providers.

Very Little Support for P2P Restrictions

In a recently conducted survey, ISPreview.co.uk has shown that only 1 out of 5 Britons support a move towards greater restrictions on illegal peer-to-peer (P2P) file sharing and other illegal ways of downloading files from the internet

The survey included 472 respondents and it turns out that only 20.7% of them support the blocking of all websites related to illegal file sharing or capping the maximum speeds of P2P services.

It seems like most people are of the opposite opinion when it comes to restricting P2P activities. Only 14.8% said they support punishing the users by limiting their overall bandwidth, while about 27% percent favoured sending sterner warning letters.

The surveyors said that only a small number of people were in support of punishments, and an even lower percentage of people supported harsher punishments. Only 6% of the respondents were found to be in favour of forcefully terminating the broadband connections of offenders and an even smaller 3.6% favoured legal action and imposition of fines.

In the recent Digital Britain report, Lord Carter has proposed to make it a legal responsibility of ISPs to be more active about the illegal downloads issue. However, the ISPA (Internet Service Providers Association) has already declared that policing the Internet is not their job, and more importantly, it is impossible for them to filter all the data that passes through the networks.
